Judge sets Sept. 8 as day for MS antitrust trial.

WASHINGTON, D.C. -- Federal Judge Thomas Penfield Jackson today set a trial date of Sept. 8 for the U.S. Department of Justice's antitrust case against Microsoft. He also gave the software giant until July 28 to respond to federal and state allegations that the company is attempting to monopolize the market for Internet software through unfair practices.

In addition, the Redmond, Wash.-based company will have until Aug. 10 to tell the court why it should not be compelled to relax licensing restrictions on its operating system. On that date, the company also will argue why it should not be forced to supply its Windows 98 OS without a browser or with competitors' browsers as requested by antitrust officials.

Microsoft Senior Vice President for Law and Corporate Affairs William H. Neukom spoke briefly with reporters following the hearing. Neukom stated "now that we have until September 8, we can ship out the next release of Windows 98 without having to change a single byte of code."

Chairman and CEO Bill Gates was also on hand to talk with reports. "By then, we will have sold several million copies, a service pack will be offered to fix all the bugs we programmed in plus as an added bonus introduce new bugs," claims Gates. He goes on to say "this is going to be long and drawn out case. By the time they figure out what to do, we will have either bought out or crushed our competitors. Besides, even it we are told to remove the browser from the operating system, do they expect us to do a massive recall like car manufacturers do when there is a defect in their product line? The chaos that would be caused if every computer owner with Windows 98 installed had to take their system to an authorized IE browser removal service would be staggering."

"We're now on the right track," said Daniel Wall, a partner at McCuthen, Doyle, Brown & Enersen in San Francisco. "If Microsoft thinks they're going to win this case with dumb analogies and buying out all the calendar manufacturers so they can release their long anticipated Microsoft Calendar, they have another thing coming." According to Wall, they almost have enough evidence to prove that Microsoft responsible for all the Year 2000 problems, all in the name of money.
